YOGESH SHARMA 2019.02.13 13:01 I attest to the accuracy and integrity of this document RSA-4224-2017 (O&M)
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH RSA-4224-2017 (O&M) Date of decision : 11.02.2019 Ishmial ... Appellant
Versus
Deep Ram (deceased) through LRs and others ... Respondents
CORAM:
HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr. K.C. Rajput, Advocate for the appellant.
**** AMIT RAWAL, J. (ORAL) Concededly, the appellant-plaintiff has already filed the objections under Order 21 Rule 97 of the Code of Civil Procedure with regard to the partition proceedings of abadi deh land, in a dispute amongst the co-sharers, which is independent proceedings under Order 21 Rules 101 and 102 of CPC. In such circumstances, the injunction suit filed by the plaintiff could not sustain.
In this view of the matter, I do not find any illegality and perversity in the judgment and decree of the lower Appellate Court, much less, no substantial question of law arises for determination. No ground for interference is made out.
Resultantly, the present regular second appeal is dismissed. 11.02.2019 Yogesh Sharma ( AMIT RAWAL ) JUDGE Whether speaking/reasoned Yes/ No Whether Reportable Yes/ No
