This is a petition under section 24 of the Code of Civil Procedure for transfer of petition initiated by respondent-husband under section 12 of the Act from the court at Fazilka to Panchkula. Respondent remains unrepresented despite service. A report has been received from the Registry that counsel for the respondent was telephonically informed as well.
It is urged before the court that petitioner has 21⁄2 years old child to look after and is dependent on her parents. Due to financial constraints, she has not been able to defend the case at Fazilka. Besides, distance between the two places is more than 200 kms.
Keeping in view facts and circumstances of the case, petition is disposed of with the direction that proceedings pending at Fazilka under section 12 of the Act be transferred to a court of coordinate jurisdiction at Panchkula.
