The instant petition has been filed on behalf of the petitioner seeking grant of regular bail in respect of aforementioned FIR. 2.

The FIR was lodged pursuant to a letter sent by Registrar Cooperative Society, Kurukshetra wherein it is alleged that President of the Ajooni Co-operative NATC Committee, Sector 17, Kurukshetra i.e.

- 2 - Bhagwant Singh Gill as well as the Assistant Manager Meenu Khanna along with other members of the family had cheated several members. It is the case of prosecution that pursuant to investigation, it surfaced that 15 persons had made a complaint with regard to the fraud in question whereas another 65 persons had also come out with the allegations that they had also deposited amounts in the said committee. As per the case of prosecution while accused Meenu Khanna is wife of Bhagwant Singh Gill, the petitioner is mother of Meenu Khanna. It is further the case of prosecution that a total of Rs.58,20,990/- was siphoned off by the accused. 3.

Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case and that she had no role whatsoever in the affairs of the committee though she is a member. It has been submitted that there is no evidence worth credence with regard to involvement of the petitioner.

Opposing the petition, learned State counsel submitted that having regard to the fact that the petitioner is closely related to Meenu Khanna who is complainant's daughter and also the fact that she is also member of the committee and during investigation sufficient evidence has been collected against her, her complicity is clearly evident. Learned State counsel has however, informed that the petitioner as on date has been behind bars since the last 2 months and 5 days and is otherwise not involved in any other case.

Without commenting anything as regards the veracity of the allegations against the petitioner, but keeping in view the fact that the petitioner is a lady aged about 58 years and has been behind bars since the last more than 2 months and has a clean record, her further detention would be justified. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on her furnishing bail bonds/surety bonds to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. 03.10.2024 ( GURVINDER SINGH GILL) mohan JUDGE Whether speaking /reasoned Yes / No Whether Reportable Yes / No
