IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH RA-CW No.127 of 2016 (O&M) IN CWP No. 23042 of 2013 Date of decision: 1.9.2017 Raj Singh .. Applicant vs Uttar Haryana Bijli Vitran Nigam Limited and another ..Respondents Coram: Hon'ble Mr. Justice Rajesh Bindal
Present:
Mr. Jai Bhagwan Sharma, Advocate, for the applicant. Mr. P.S. Poonia, Advocate, for the respondents. Rajesh Bindal, J.
Learned counsel for the applicant submitted that inadvertently submission was made before the Court on 25.1.2016 that the issues raised in the present writ petition are covered by the judgment of this Court in CWP No.4016 of 2014-Satyabir Goyal vs. Dakshin Haryana Bijli Vitran Nigam and others, decided on 14.10.2015. In fact, in that case theft was admitted, whereas in the case in hand, it is the case set up by the Uttar Haryana Bijli Vitran Nigam regarding theft of energy, whereas theft has not been admitted.
Considering the aforesaid fact, in my opinion, the order dated 25.1.2016 deserves to be recalled.
Ordered accordingly.
Let the writ petition be listed as per roster on 21.9.2017. (Rajesh Bindal) Judge 1.9.2017 sharmila Whether speaking/reasoned :
