For reasons mentioned in the application, which is supported by an affidavit, the delay of 24 days in re-filing the appeal is condoned. Application is allowed.

MAIN Counsel for the appellant, at the outset, submitted that the counsel representing the parties before the trial court has informed him that the partition proceedings pending before the revenue authorities has made substantial progress and is at final stage. Hence, he has instructions to withdraw the appeal. However, he submits that he would pray for short adjournment to file an affidavit of the appellant in support thereof.
