The petition for transfer may not be necessary for prosecution particularly in view of the fact that the parties are reported to have filed a petition for divorce by mutual consent in the Court at Hoshiarpur. The petition is dismissed as not requiring any adjudication in view of the subsequent event of both the parties having filed an application for divorce by mutual consent.

The petitioner is at liberty to approach this Court seeking for modification of this order if such averment made by the respondent, for which proof is also offered, is brought under challenge which can vitiate the proceedings before the Court at Hoshiarpur.
