NAMIT KUMAR J. (Oral) The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondents to issue the retiral benefits of the petitioner such as leave encashment, gratuity, amount of pension after computation and 50% amount of pension along with interest @ 18% per annum on the delayed payments.

Learned counsel for the petitioner submits that the petitioner retired from service on attaining the age of superannuation on 31.05.2024 and has only been granted leave encashment, general provident fund and 50% of pension and whereas gratuity and payment of computation of pension has not been released. CWP No.24793 of 2024 (O&M) the petitioner went on Ex-India leave after seeking permission from the Department and he was to join back on 29.01.2024, however, he fell ill at Australia and joined back on 05.02.2024 and for the said reason, the remaining retiral dues of the petitioner have not been released. On receipt of advance copy of the writ petition, Mr. R.P.S. Bara, Advocate has appeared on behalf of the respondents and submits that the case of the petitioner for grant of leave for the said period is under process and on regularizing the same, his retiral benefits shall be released within a period of three months from today. In view of the statement made by learned counsel for the respondents, the instant petition has been rendered infructuous and the same is disposed of accordingly.

In this view of the matter, it is directed that the necessary benefits shall be released to the petitioner within a period of three months as per the statement made above.
