In view of the averments made in the application, delay of 61 days in re-filing the appeal is condoned.

RSA No.3956 of 2018 Learned counsel for the appellant seeks leave to withdraw the present appeal in view of the fact that the matter has been compromised out of Court between the parties and as such, the appellants does not want to pursue the main appeal.

Leave is granted.

Accordingly, the present appeal is dismissed as withdrawn. It is informed by learned counsel for the respondent that two identical matters i.e. RSA No.3713 of 2018 and RSA No.3839 of 2018 are pending for disposal in similar terms.

Let the said cases be fixed for 25.02.2019.
