RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 438 Cr.P.C. praying for grant of anticipatory bail to the petitioner in case FIR No.0092, dated 28.09.2015 (P-1), under Sections 498-A, 406, 506, 34 IPC, registered at Police Station Valtoha, District Tarn Taran. After arguing for some time counsel for the petitioner fairly submits that though the petitioner was earlier granted anticipatory bail as well as regular bail but due to his illness, he could not appear, thus, he was declared proclaimed person on 18.10.2022.
Learned State counsel has also affirmed the same. Keeping in view the overall facts and circumstances of the present case, counsel for the petitioner prays for withdrawal of this petition with liberty to petitioner to surrender before the Court of competent jurisdiction.
In view of the above-mentioned facts, the present petition is disposed of with liberty to the petitioner as prayed for. However, it is MEENU 2022.11.16 17:21 I attest to the accuracy and integrity of this order/judgment
CRM-M-52754-2022 -2directed that if the petitioner surrenders before the Court of competent jurisdiction within a period of seven days from today and files an appropriate application for redressal of his grievances, the concerned Court is requested to decide the same expeditiously in accordance with law.
