(ORAL) Defendants are in second appeal against the judgment of reversal dated 17.12.2016 passed by learned Additional District Judge, Yamuna Nagar at Jagadhri, whereby the Civil Appeal filed by the plaintiff has been allowed; and the suit of the plaintiff has been decreed in toto. Present appeal is of the year 2017; in which notice of motion was issued vide order dated 27.02.2017. Thereafter, the matter has been adjourned due to non-appearance of learned counsel for the appellants on 26.05.2023 and 24.02.2025; and at request of learned counsel for the appellants on 03.10.2017, 10.10.2017 and 23.10.2018. Today also, in first round, learned proxy counsel appeared and made a request for pass over, but in second round, none appeared on behalf of the appellants. A bare reading of the above facts shows that the appellants have exhibited an utterly casual and careless attitude in their pursuit of the DIVYANSHI 2025.11.28 18:01 I attest to the accuracy and integrity of this document
RSA-442-2017 (O&M) - 2present litigation. It is to be appreciated that very valuable public time of the Court has been expended in affording opportunities to the appellants in the interest of justice. It is clear that neither the appellants nor their counsel is seriously interested in pursuing the present matter. Thus, this Court is left with no other option except to dismiss the same for nonprosecution. Ordered accordingly.
