(ORAL) Despite specific observation made in the order dated 02.11.2018 that no further adjournment shall be entertained, learned proxy counsel for the appellant requests for adjournment on the ground that arguing counsel is out of station, which is no ground to adjourn the case in view of judgment of Hon'ble the Supreme Court in Civil Appeal Nos.9142-9144- 2010, titled as "Ram Siromani Tripathi and ors. vs. State of U.P. and ors.", wherein it has been held that seeking adjournment on the ground that counsel is out of station is not a valid ground.
In view of above settled proposition of law of the Hon'ble Apex Court, request for adjournment is rejected. Therefore, in view of order dated 02.11.2018, instant appeal is dismissed for want of prosecution.
