Naresh Kumar Sanghi, J.(Oral) At the very outset, Mr.Amit Dhawan, learned counsel for the respondent-husband has pointed out that as per telephonic communication received from the counsel representing the respondent-husband in the trial Court, the case has been decided and a decree of divorce has been passed, therefore, the present petition has been rendered infructuous. T.A.No.443-2014 (O&M) (2) Learned counsel for the applicant-wife submits that exparte decree has been passed and the same has been confirmed from the counsel at Ludhiana. However, he submits that the present petition be kept pending so that the applicant-wife may move an application for setting aside the ex-parte decree before the Court below.
The prayer for adjournment of this petition by the learned counsel for the applicant-wife is declined. Since the case sought to be transferred from the learned trial Court, Jalandhar, to the Court of competent jurisdiction at Ludhiana has already been decided, therefore, the present petition is rendered infructuous. Ordered accordingly.
