Mr. Ankit Bishnoi, Advocate for the petitioners. *** MANOJ BAJAJ, J. (Oral) Petitioner has filed this petition under Sections 11 and 12, Contempt of Courts Act, 1971 seeking initiation of contempt proceedings against respondents for alleged violation of order dated 08.08.2022 passed by this Court in CM-9628-CII-2022 in CR-2907-2022. Learned counsel contends that on 08.08.2022, while issuing notice of motion to the respondents, it was directed that the parties would maintain status quo regarding constructions at the spot. He submits that this order was communicated to the respondents, and despite receiving it, they are continuing with the construction activity. In this regard, he has invited the attention of the Court to the photographs (Annexure P-2) to submit that the defendants are willfully and deliberately disobeying the directions of this Court, therefore, proceedings under the Contempt of Courts Act be initiated against them.
After hearing the learned counsel and considering the submissions, this Court finds that there is nothing on record to show that the order dated 08.08.2022 stands communicated to the respondents and even in GEETA RANI 2022.11.24 15:08 I attest to the authenticity and integrity of this document
COCP-2488-2022 (O&M) -2the revision petition, no particulars regarding any date or mode of communication are given, and further the photographs relied to allege violation are not enough to show that the construction raised on the subject land pertains to the period after passing of status quo order. Thus, no ground is made out for initiating contempt proceedings.
