Learned counsel for the petitioner, at this stage submits that even the notice which was issued to the petitioner ought to have been withdrawn, even if the order which was passed on the same date for suspension of the license has been withdrawn and therefore the writ petition should not be rendered infructuous. This Court is unable to agree with the learned counsel for the petitioner. When the order itself by which the petitioner's license has been suspended is stated to be withdrawn within a period of two days as submitted by the learned counsel for the State on instructions from Dr. Navreet Kaur, District Controller, Food, Civil Supplies & Consumer Affairs, S.A.S.Nagar, Mohali, then there is no need to withdraw the notice and therefore, the contention raised by learned counsel for the petitioner is hereby rejected.

It is also clarified that the withdrawal of the suspension order itself would not preclude the State-respondents to pass any order in accordance with law or to proceed against the petitioner, in case it is so permissible in law.

The writ petition is disposed of as having been rendered infructuous.
