(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Pathankot to Amritsar. It is urged before the court that the distance between the two places is about 120 Kms. Besides, applicant has to look after a 05 years old female child. She has no source of income and is dependent upon her widow mother. Thus, it would be difficult for the applicant-wife to effectively defend the proceedings at Pathankot. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Pathankot be transferred to a court of co-ordinate jurisdiction at Amritsar. The petition is allowed in these terms.
