(ORAL) Present Second Appeal has been filed by the plaintiff along with an application for condonation of delay of 485 days in filing the appeal, against the judgment and decree dated 09.02.2016 passed by learned Additional District Judge, Sangrur; whereby the appeal filed by the defendant/respondent No.1 herein has been dismissed, however, the defendant is held entitled to continue using the electric connection in dispute for irrigating his land as per his share/turn. Order sheets reveal that even though present appeal is of the year 2017, yet notice is to be issued in the main appeal as the matter has been adjourned either at request of; or due to non-appearance of learned counsel for the appellant. Today, learned proxy counsel appearing on behalf of arguing counsel submits that LRs of the deceased-respondents DIVYANSHI 2025.08.22 17:00 I attest to the accuracy and integrity of this document

However, order sheets reveal that the time in this respect, has been taken by learned counsel for the appellant as far back as on 19.04.2024, as evident from order of the said date. The amount of judicial time wasted in granting adjournments to the appellant since 2017 till date cannot be recompensed; however, does not justify grant of further opportunity.

Therefore, it can safely be presumed that the appellant or his counsel is not interested in pursuing the present appeal. In view of the above, present Second Appeal stands dismissed for non-prosecution.
