At the outset, State's counsel, on instructions from ASI Kuldeep Singh, submits that the petitioner has concealed his criminal history and in paragraph no.5 of the petition, he has explicitly stated that he is not involved in any other case, which is contrary to her instructions obtained from the police, copy whereby has been supplied to counsel for the petitioner in Court.

At this stage, counsel for the petitioner wants to withdraw the present petition with liberty to file a fresh one.

Given above, the present petition is disposed of, having been withdrawn, with liberty to file a fresh one in accordance with law. It is clarified that filing and withdrawal of the present petition shall not come in the way of filing a fresh petition by the petitioner.
