SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked for the second time under Section 528 of BNSS, for grant of interim regular bail to the petitioner for a period of 04 weeks in FIR No.42, dated 21.04.2020, under Sections 302, 307, 341, 188, 148, 149 IPC and Sections 25 and 27 of Arms Act, 1959, registered at Police Station Makhu, District Ferozepur to attend the marriage of his sister, which is fixed for 09.11.2024. In compliance of the order dated 30.09.2024, short affidavit dated 03.11.2024 of Gurdeep Singh, PPS, Deputy Superintendent of police Zira, District Ferozepur has been filed on behalf of the respondent-State, which is taken on record. Relevant para No.3 of the said status report reads as under:- That in compliance of said order it is submitted that factum of marriage of sister of the petitioner was got verified through the Station House Officer, Makhu. CRM-M-48731-2024 -2of Udham Singh r/o Harike, Pargat Singh Panch son of Kulwnt Singh r/o Harike, Jaspal Singh (Manager Satluj marriage Palace, Harike), Balbir Singh son of Joginder Singh resident of Near Govt. Hospital, Harike, Jai Paul son of Kartar Chand r/o Model Town Noor Mehal, Jagan Nath Namberdar, and Balvir Chand MC were joined in the enquiry and produced their affidavits before the investigating officer. The respectable persons of village Harike, Tehsil Patti have also tendered Panchayatnama wherein, they have specifically mentioned that marriage of the sister of the petitioner namely Navdeep Kaur d/o Balvir Singh is being solemnized with Hardeep Paul son of Jai Paul resident of Noor Mehal."

A perusal of the above would depict that the factum of marriage of the sister of the petitioner was got verified through the Station House Officer, Makhu and the same is correct.

In view of the above, the petitioner is directed to be released on interim bail for a period of 10 days w.e.f. today i.e. 05.11.2024, subject to his furnishing personal/surety bonds to the satisfaction of trial Court/Duty Magistrate.

It is however, made clear that the petitioner shall surrender to the Jail authorities, concerned on or before 14.11.2024, by 05:00 p.m. The present petition is disposed of in the aforesaid terms.
