**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 81 dated 19.10.2015 under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Islamabad, Amritsar, District Amritsar.

Learned counsel for the petitioner submits that 25 grams of heroine was allegedly recovered from the petitioner which falls under the non-commercial quantity and there is no other case pending or decided against the petitioner and he has been in custody for the last more than 09 months.

Learned State counsel, on instructions from HC Prem Pal Masih, submits that the petitioner was declared proclaimed offender and was arrested later on. Moreover, in the present case, one prosecution witness has been examined-in-chief and his cross-examination is to be GURPREET SINGH 2020.01.23 16:49 I attest to the accuracy and authenticity of this document chandigarh conducted.

CRM-M No. 45555 of 2019 -2The petitioner has been in custody for the last more than 09 months. There is no other case pending or decided against him. Trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
