**** The case has been taken up for hearing through video-conferencing.
Perusal of the record would show that the regular bail was declined to the petitioner vide order dated 20.01.2017 by the High Court. Since the investigation qua bank officials was in progress, therefore, State was directed to file status report with regard to the investigation. Thereafter, the case was adjourned on number of occasions.
Now the status report by way of affidavit of Dharam Paul, PPS, Assistant Commissioner of Police, (North) Ludhiana has been filed. As per para No.4 of the status report, during further investigation on 15.02.2017, the complainant made a supplementary statement leveling allegations regarding fraud and forgery by the petitioner and his co-accused in connivance with bank manager namely Paramjit Lal. Paramjit Lal (Bank Manager) was accordingly nominated in the present FIR. Two of the accused namely Brij Lal and Jatinder Jogi are still absconding. IOIN-CRM-M-37816-2016 in -2CRM-M-37816-2016 accused namely Narinder Kumar, Paramjit Lal and the present petitioner. First challan was submitted on 04.09.2016 and supplementary challan was submitted on 20.10.2018. Charges have already been framed against the petitioner. The prosecution evidence has been recorded in part and the trial is pending.
In view of aforesaid status report, no further order is required to be passed as the requirement was only to ascertain the status of investigation. The law will take its own course as against the persons who are still absconding and who are facing trial.
