**** Challenge in this appeal is to the order dated 05.12.2013 vide which the respondents/accused were acquitted in criminal complaint filed by the petitioner.
The present appeal is pending since 2013. However, a perusal of the last order show that the petitioner has not addressed the arguments for the last many dates. Vide order dated 12.05.2015, the appeal was dismissed for non-prosecution. Later on, on filing an application for restoration, the appeal was restored vide order dated 05.10.2015 on payment of costs of Rs.2,000/- to be deposited in the Mediation and Conciliation Centre of this Court. Thereafter again, the matter remain pending for awaiting the report, if the costs has been deposited or not.
On the last date of hearing, no one appeared on behalf of the applicant/appellant and it was directed that the Registry will sent a notice to counsel for the applicant/appellant with a note on the summons that in case, he failed to inform the Court about depositing of the costs or failed to appear in the case on the next date of hearing i.e. today, the case will be dismissed for non-prosecution. As per office report, counsel for the applicant/appellant has been duly informed. There is no representation on behalf of the applicant/appellant. The situation was not different on the last date of hearing, as well.
Dismissed for non-prosecution.
