(Oral) Learned counsel for the parties are ad idem that earlier civil suit filed at Khadur Sahib has been dismissed in default and the same has not been got revived so far. Further, order dated 18.9.2014 ( Annexure P-4) passed by the learned civil court has also not been challenged by the plaintiff-respondents herein. Since the main ground for seeking transfer of civil suit No.2806 of 14.10.2014 titled as Smt. Kamla @ Kamal Bedi and others Vs. Punajb State and others, pending before the learned civil AMIT KUMAR 2016.05.09 18:04 I attest to the accuracy and authenticity of this document
TA No. 634 of 2014 (O&M) court at Amritsar, was the pendency of another identical civil suit at Khadur Sahib and said ground is no more available to the present applicants, instant transfer application has been rendered infructuous and the same is disposed of, as such. However, liberty is granted to the applicants to file similar transfer application, if the plaintiffsrespondents get their civil suit revived before the civil court at Khadur Sahib. It also goes without saying that the applicants shall be at liberty to raise all possible pleas available to them before the learned civil court at Amritsar.
Disposed of, accordingly.
