Vide order dated 09.07.2025 passed by a Coordinate Bench of this Court, the present application was adjourned to 29.07.2025. On oral request of learned counsel for the parties, the same is taken up on Board today itself.

In view of the averments mentioned in the application, which is duly supported by an affidavit for applicant/appellant No.2, the same is allowed.

RSA-4216-2018 (O&M) -2 - RSA-4216-2018 (O&M) Plaintiffs are in Second Appeal against the concurrent judgments and decrees of the learned Courts below, whereby the suit filed by the plaintiffs for permanent injunction, has been dismissed by both the Courts below.

Learned counsel for the parties are ad idem that the matter stands compromised between the parties vide Compromise Deed dated 06.05.2025 (Annexure-C).

In view of the statement made by learned counsel for the parties, no further direction is required to be issued in the present case; and the same is accordingly disposed of.
