HARYANA AT CHANDIGARH RSA No.4712 of 2017 (O&M) Date of Decision.02.04.2019 Parveen Rani and another ...Appellants Vs Amrik Singh and others

...Respondents

CORAM:HON'BLE MR. JUSTICE AMIT RAWAL

Present:

Mr. Anurag Chopra, Advocate for the appellants.

Mr. Sandeep Jasuja, Advocate for the caveators/respondents.

-.- AMIT RAWAL J. (ORAL) Mr. Anurag Chopra, learned counsel appearing on behalf of the appellants submitted that though the suit for injunction filed by appellants-plaintiffs was decreed, but reversed by the lower Appellate Court and the decision in regular second appeal arising out of dismissal of the suit of appellants-plaintiffs would pale into insignificance as during interregnum partition proceedings have already been effected and parties have already taken their respective possession. This fact has not been disputed by the counsel appearing for the caveators-respondents.

In view of statement made by counsel for the appellants, no further cause would survive to dilate upon the finding of fact and law rendered by Courts below. Resultantly, the second appeal is dismissed.
