(ORAL) Learned counsel for the appellant submitted that the regular second appeal bearing No.2420 of 2017 filed by the appellant-plaintiff against judgments and decrees of the Courts below dismissing the suit, stands dismissed on 14.11.2017. The present appeal is arising out of disposal of counter-claim and the matter would be covered by the decision rendered in the aforementioned regular second appeal.

Resultantly, the present appeal is dismissed in terms of judgment passed by this Court in RSA No.2420 of 2017 decided on 14.11.2017.
