HARSH BUNGER, J. (ORAL) On the oral request of learned counsel for the petitioner, the main case is taken up on Board today itself, which is otherwise pending for 17.05.2023.

CRM-14647-2023 and CRR-2490-2022 Criminal Revision No.2490-2022 has been filed by the petitioner, seeking quashing of impugned order dated 08.09.2022 passed by learned Additional Sessions Judge, Karnal, whereby, an application moved by him under Section 167(2) of the Code of Criminal Procedure (for short `Cr.P.C.) for grant of default bail, was dismissed and a further prayer has been made for releasing the petitioner on bail. Learned counsel for the petitioner has informed that during the pendency of revision petition before this Court, the petitioner had filed GURPREET KAUR 2023.04.17 17:21 I attest to the accuracy and authenticity of this order/judgment

CRM-14647-2023 in/and CRR-2490-2022 -2another application for default bail under Section 167(2) of the Cr.P.C. before the Court of Additional Sessions Judge, Karnal; however, the same was ordered to be dismissed as withdrawn on 31.03.2023 and a copy thereof has been handed over in the Court today, which is taken on record, subject to all just exceptions and is marked as `Mark A'. Learned counsel for the petitioner submits that he has instructions to withdraw the instant revision petition and afore-said application bearing CRM-14647-2023 to this effect has also been filed, which is supported by an affidavit of wife of the petitioner namely, Shamsher Singh @ Shammi.

In view of the above, the prayer of the petitioner in CRM-14647-2023 to withdraw the main case is accepted and the instant revision petition i.e. CRR-2490-2022 is dismissed as withdrawn. A copy of this order be sent to the concerned Court below through learned State counsel.
