   DDR No.03 dated 27.05.2025, registered u/s 109, 191(3), 190, 351(2) of the BNS, 2023 (New Sections 115(2), 118(1), 117(2), 118, 191(3), 190 of the BNS, 2023) and Sections 25, 27, 54, 59 of Arms Act, at Police Station Sadar Kotkapura, District Faridkot in cross FIR No.81 dated 26.05.2025, registered u/s 109, 191(3), 190, 351(2) of the BNS 2023 and Sections 25, 27, 54, 59 of Arms Act, at Police Station Sadar Kotkapura, District Faridkot  $% &  & '(     ) *+ ,The present petition for grant of pre-arrest bail has been filed by petitioners, who are accused in DDR No.03 dated 27.05.

2025, registered against them for commission of offence punishable u/s 109, 191(3), 190, 351(2) of the BNS, 2023 (New Sections 115(2), 118(1), 117(2), 118, 191(3), 190 of the BNS, 2023) and Sections 25,27,54,59 of Arms Act, at Police Station Sadar Kotkapura, District Faridkot in FIR No.81 dated 26.05.2025, registered u/s 109, 191(3), 190, 351(2) of the BNS 2023 and Sections 25, 27, 54, 59 of Arms Act, at Police Station Sadar Kotkapura, District Faridkot.

-2be noticed hereinbelow:- "FIR No.81 dated 26.05.2025 was registered against the complainant party at the instance of petitioner party for commission of offence punishable u/s 109, 191(3), 190, 351(2) of the BNS 2023 and Sections 25, 27, 54, 59 of Arms Act, at Police Station Sadar Kotkapura, District Faridkot. On the following day i.e. 27.05.2025, DDR No.03, came to be registered against the present petitioners and others. A bare perusal of the copy of DDR goes to show that Sewak Singh, who claims himself to be owner of transport company as also the president of the truck union, Rama Mandi from 2021 to 2024 alleged that on 26.05.2025, his friend Manjot Singh was visiting him and had disclosed that measurement of land of his aunt was to be demarcated at village Sibbian, Distt. Faridkot.

When they reached at Talwandi Sabo, then they met his friend Parampreet Singh @ Gaggu, who also accompanied them to the site. Sewak Singh further alleges that Gurditt Singh (petitioner No.2) and Sukhjinder Singh (petitioner No.3) and Jagsir Singh (petitioner No.1) were also present at the site. Petitioner Nos.2 and 3 were armed with Gandasha and Kirpan whereas Jagsir Singh (petitioner No.1) was empty handed. After verbal altercation occurred at the site, gunshots were fired by Gora Singh and Sandeep Singh and Hardev Singh, who were accompanying Guddi etc. Gunshot injuries were suffered by Sewak Singh at various parts of his body, the details of which have been mentioned. Motive for the assault has also been pointed out."

Learned counsel for the petitioner contends that being case of version and cross-version it is yet to be ascertained as to which of the parties was aggressor, the true genesis of the incident as not been correctly portrayed by the complainant of the DDR, which was lodged after the criminal proceedings vide FIR No.81 dated 26.05.2025 were initiated against complainant party. It is further the submission of learned counsel that even if the allegations as levelled in the DDR are taken to be true at its face value (though not admitted to be true), the role attributed to the present petitioner is that they were members of the unlawful assembly, some of whom were armed with pistols and had fired shots. It has also been noted hereinabove that petitioner Nos.2 and 3 were armed whereas petitioner No.

1 was unarmed and no specific role has been assigned to them. It is further the submission of learned counsel that parties have amicably resolved the dispute and a quashing petition i.e. CRM-M-70615-2025 based on the compromise is pending adjudication before this Court. In view of the submission advanced by learned counsel for the petitioners, but without expressing any opinion on the merits of the case, the petitioners are hereby directed to join investigation within seven days from today and co-operate in the same.

-3shall be released on interim bail on their furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. They shall also abide by conditions as envisaged under Section 482(2) BNSS. Adjourned to 10.03.2026.- . /      0
