Plaintiff/appellant is in second appeal against concurrent findings recorded by the Courts below whereby her suit for permanent injunction was dismissed by learned Civil Judge (Junior Division)Hathin vide judgment and decree dated 17.11.2017 and findings thereof affirmed in appeal by the learned District Judge,Palwal vide judgment and decree dated 23.5.2018.

Briefly noticed,plaintiff was working as Anganwari Worker at Village Ransika,Tehsil Hathin,Distt.Palwan since 2007. Later on she was elected as Sarpanch of Village Ransika on 17.1.2016. On her election as Sarpanch she was issued letter dated 20.4.2016 by the defendants stating therein that she could not hold two posts. Plaintiff replied the said letter by contesting the contents thereof. Still defendants issued another letter dated 26.5.2016 reiterating their stand. Apprehending her removal from the post of Anganwari Worker, plaintiff/appellant filed suit for injunction seeking permanent injunction restraining defendants from removing her either from Rajinder Parshad Joshi 2018.07.30 11:10 I attest to the accuracy and integrity of this document

RSA 4400/2018 (O&M) the post of Sarpanch or that of Anganwari Worker. As noticed above, her suit as well as appeal was dismissed by the Courts below. Hence the present second appeal.

At the time of arguments, counsel for the appellant submits that the plaintiff/appellant has resigned from one post,therefore, prays for withdrawing the appeal.

Dismissed as withdrawn.
