Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent to enhance w.e.f. 09.11.2022, when the petitioner completed 06 months under suspension, his subsistence allowance from 50% of the leave salary to 75% of the leave salary as permissible to the petitioner under Rule 7.2(1)(ii)(a) of Punjab Civil Services Volume 1 Part 1 read with Regulation 17 of the Punjab State Warehousing Corporation Staff (Conditions of Service (Group C and D) (Service) Regulations, 2002 and release interest @ 9% on the arrears on this account from 09.11.2022 till actual date of payment. Further prayer has been made to direct the respondent to reinstate the petitioner in service with immediate effect due to inordinate delay in completing the departmental proceedings against the petitioner.

Learned counsel for the petitioner submits that the petitioner has submitted repeated representations dated 22.04.2024, 25.07.2024 and 16.08.2024 (Annexures P-7 to P-9), however, neither the same have been replied to nor the subsistence allowance has been enhanced. He further submits that the petitioner would be satisfied in case time bound directions are issued to the respondent to consider and decide the representations dated 22.04.2024, 25.07.2024 and 16.08.2024 (Annexures P-7 to P-9), by passing a speaking order. 3.

Ms. Sunder Kumari, Advocate for Ms. Shivani Sharma, Advocate, accepts notice on behalf of the respondent and has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to the respondent - Managing Director, Punjab State Warehousing Corporation (PSWC), to consider and decide the representations dated 22.04.2024, 25.07.2024 and 16.08.2024 (Annexures P-7 to P-9), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
