(ORAL) The short point involved in the present appeal is whether declaration of ownership in respect of suit property situated in Haryana could be issued by Civil Court or under Section 13 of the Punjab Village Common Lands Act as applicable to Haryana. Both the Courts below have held that the Civil Court did not have jurisdiction.

The appeal is also accompanied by an application for condonation of delay of 262 days in filing the appeal. The explanation lacks bona fides.

I do not subscribe to the argument of Mr. Saini to form a different opinion than the one already arrived at by both the Courts below. No ground for interference is made out. Resultantly, the second appeal is dismissed both on the ground of limitation as well as on merit.
