The present appeal pertains to the year 2018 and the same is still at the stage of preliminary hearing inasmuch as notice of motion is yet to be issued. On 07.11.2024 the following order was passed : 'Learned counsel for the appellant fairly submits that he is not in contact with the appellant and, therefore, the order dated 21.02.2024 could not be complied with. Hence, he prays for some more time to complete his instructions.

In light of the above, let Court notice be issued to the appellant for the date fixed for compliance failing which the matter shall proceeded in accordance with law. Adjourned to 20.02.2025.'

As per the Office report, the sole appellant was not found residing at the given address. There is no other address of the appellant AMAN JAIN 2025.02.24 09:10 I attest to the accuracy and integrity of this order/judgment

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 5.
