******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.124 dated 17.09.2019 registered for the offences punishable under Sections 420, 467, 468, 471 and 120-B of Indian Penal Code, at Police Station Bareta, District Mansa.
Heard.
Learned State counsel on instructions from ASI Mewa Singh submits that the petitioner was running a medical lab. The police has verified the diploma of petitioner and found that the same is fake and forged as the institute, which allegedly issued that diploma certificate to petitioner, nowhere exists. Custodial interrogation of the petitioner is required to enquire about the source of getting the said diploma certificate. Learned counsel for the petitioner submits that the petitioner is running the medical lab for the last seven years and was not aware that the institute, which issued the diploma certificate to petitioner, is fake one. CRM-M-45652 of 2019 -2Keeping in view the fact that the petitioner was not having requisite qualification to run the medical lab and the diploma, which was produced before the police has been found to be forged and fake document, I agree with learned State counsel that custodial interrogation of the petitioner is required in this case to verify the facts relating to issuance of the diploma certificate to the petitioner.
In view of above, I find no reason to exercise discretionary power of this Court to extend the benefit of anticipatory bail to petitioner, at this stage.
Dismissed.
