Learned counsel for the petitioner contended that due to mis-communication between the counsel and the petitioner, the petitioner failed to appear before the trial Court and his bail/surety bonds were cancelled and forfeited to the State. The other co-accused is already on bail. He further submitted that the petitioner is ready to surrender himself before the trial Court.

Mr. Subhash Godara, Additional Advocate General, Punjab, accepts notice on behalf of respondent-State and submitted that the petitioner has not been declared proclaimed offender in this case and nonbailable warrants have been issued against him. 4.
