Learned counsel for the parties are ad idem that the matter has since been settled between the parties and an agreement has been drawn up after recording their statements before the Mediation & Conciliation Centre of this Court. A copy of the settlement has been appended with the case file along with the report of the Mediators as well as the statements of the parties which are marked as 'Mark-A'. The following terms have been agreed to, in the settlement:
RSA No.4973 of 2017 -2- "10. It has been agreed on the following terms settled between the parties:- i. It has been admitted and agreed between the parties that as per judgment and decree passed by the first appellate Court they have no objection if the passage running through the land comprised rectangle no.201, Killa No.14/2 (0-8) at village Chautala, Tehsil Dabwali, District Sirsa at the spot.
ii) That both the parties agrees that they shall have no objection if the present RSA be decided/disposed off as per the settlement/agreement entered into the parties. iii) It is further agreed between the parties that they shall not interfere in the peaceful possession of the suit property in question. They also agree with the settlement they shall not raise any further claim regarding the present suit property."
In view of the settlement arrived at between the parties, learned counsel for the appellants seeks permission to withdraw the present appeal.
RSA No.4973 of 2017 -3In terms of the compromise, the appeal stands dismissed as withdrawn and the judgment and decree of the First Appellate Court shall be maintained.
