On 02.04.2025 the following order was passed : " The present appeal pertains to the year 2023 and the same is still at the stage of preliminary hearing inasmuch as notice in the application for condonation of delay and notice of motion is yet to be issued. The case has repeatedly been adjourned on the request of the learned counsel for the appellant on one ground or the other. Today, though no adjournment slip is filed, a request for an adjournment is made on behalf of the arguing counsel for the appellant on the ground that he is in personal difficulty. Though no ground is made out to further adjourn the matter, however, in the interest of justice, adjourned to 08.12.2025 subject to payment of ₹5,000 (rupees five thousand) as costs to be deposited with the YOGESH SHARMA 2026.01.21 10:01 I attest to the accuracy and authenticity of this order/judgment.

As per the office report, costs have not been deposited till date. Today, on first call none appeared on behalf of the appellant and the matter was passed over. On second call none has put in appearance on behalf of the appellant. It appears that the appellant is not interested in pursuing the present appeal. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
