DEEPAK GUPTA , J.(Oral) By way of this petition under Section 439 Cr.P.C., petitioner prays for grant of regular bail in case FIR No.87, dated 03.11.2022, under Sections 21, 22 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act'), registered at Police Station Valtoha, District Tarn Taran.
Allegations are that 630 lose intoxicating tablets containing the salt of Tramadol HCL having weight of 320 grams; and 5 grams of heroin were recovered from the possession of co-accused Gursewak Singh, who in his disclosure statement nominated the petitioner to be the supplier.
Learned counsel for the petitioner contends that petitioner was allowed interim bail, vide order dated 09.01.2023 (Annexure P-1) till the receipt of the FSL report. However, after receipt of the FSL report, regular bail application of the petitioner was declined on 20.05.2023. Learned counsel further contends that no recovery was effected from the petitioner, though the petitioner is involved in one more case pertaining to NDPS Act, as per details given in para No.7 of the petition and that he is on bail in that case. Learned State counsel concedes that no recovery has been effected from the petitioner.
As per the custody certificate placed on record by learned State counsel, petitioner is in custody for the last 06 months and 25 days. The trial may take time to conclude.
Having regard to the aforesaid facts and circumstances, particularly the fact that no recovery is effected from the petitioner, but without commenting anything on the merits of the case, he is admitted to bail. He is ordered to be released on bail on his furnishing requisite bail bonds and surety bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate concerned.
