< for grant of anticipatory bail in FIR No.99 dated 26.07.2025 under Section 69 of Bharatiya Nyaya Sanhita, 2023 registered at Police Station Rahon, SBS Nagar, Punjab. 2.

As per facts of the case, prosecutrix age about 40 years gave her statement that she is BA pass. Her parental family owned Flour Mill in Kot Ranjha village. In 2016, she went to Electricity Department in connection with high electricity bill of Flour Mill. She came in contact with Bhupinder Singh, who assured to resolve the matter. With the passage of time, he pressurized to get friendly with him. She refused but he insisted for friendship and assured to marry her. She had disclosed Bhupinder Singh that she is elder to him and family is looking suitable match for her. She came

 

 

 

 

under his influence and their closeness grew. She disclosed their relationship to his family. Family of Bhupinder Singh did not agree and finally he moved in a rented house in Rahon. On 06.06.2016, they started residing at Rahon. During this period, he maintained physical relation with her with the assurance to marry her. During this period, she was under the belief that he will perform marriage with her. In January, 2024 her health deteriorated, and she was diagnosed with blood cancer. Bhupinder Singh started avoiding her. He also refused to maintain physical relation with her due to her health issue and ultimately refused to marry her. With these allegations, present FIR has been registered.

Learned counsel for the petitioner pointed out that relationship between the prosecutrix and petitioner was consensual. They remained in relationship for 9 years. There was no assurance of marriage. Petitioner has got married in February, 2025. There is huge delay in lodging the FIR. At present, prosecutrix is 42 years of age. Present FIR has been lodged under the influence of sister of the prosecutrix who is constable in the office of SSP, Jalandhar. He has also levelled serious allegations against the prosecutrix. Petitioner is ready to join the investigation. His anticipatory bail application was wrongly declined by learned Additional Sessions Judge, SBS, Nagar vide order dated 12.08.2025 (Annexure P-6). He is ready to abide by the terms of bail order. Therefore, his anticipatory bail application may be allowed.

I have considered the arguments and have gone through the record. Contents of FIR clearly indicate that prosecutrix is well qualified matured lady. She came in contact with the petitioner in the year 2016 and finally, FIR is lodged on 26.07.2025. Present petitioner has not denied the relationship. He categorically stated that they were in consensual relationship and finally it came to an end. Petitioner is ready to join the investigation. Merits of the case can be seen during trial. No useful purpose would be served by sending the petitioner behind the bars. Considering the aforesaid factual position, anticipatory bail petition filed by petitioner Bhupinder Singh is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482 (2) of BNSS, 2023.
