Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to count the workcharge/daily wages service rendered by the petitioner followed by his regular service taken into account as qualifying service for computing the pensionary benefits.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding legal notice dated 26.05.2024 (Annexure P-2). He submits that at this stage, petitioner would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

Mr. Gagneshwar Walia, Advocate, accepts notice on behalf of the respondents and submits that the present petition has been filed after a period of about 10 years of retirement of the petitioner and in the event of acceptance of the claim of the petitioner, the arrears shall be restricted to 38 months prior to filing of the present petition. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1 to decide legal notice dated 26.05.2024 (Annexure P-2), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of three months from the date of receipt of certified copy of this order.
