In the present appeal, the challenge is to the impugned order dated 12.09.2023 passed by the learned Single Judge in CWP-20051-2023, by which, the remanding back the case to the authorities concerned for initiating the fresh partition proceedings in a manner required, has been upheld by the learned Single Judge.

In the present appeal, the appellants are only required to prove as to how the order passed by the authorities concerned which has been upheld by the learned Single judge, is perverse to the facts or settled principle of law. Even if, two views are possible, the view taken by the authorities which has been upheld by the learned Single Judge, cannot be interfered with merely because the appellants are projecting the other view to be accepted.

In the present appeal, the learned single judge has only upheld the order passed by the learned Financial Commissioner, by which, the case was remanded back to the concerned authorities for initiating the fresh partition proceedings in accordance with law.

Learned counsel for the appellants has not been able to show that as to how, the said order of the learned Financial Commissioner is perverse to the facts or settled principle of law. 5.
