Prayer in this petition is for release of petitioner on emergency parole for two weeks under Section 3(1) (a) of the Punjab good conduct Prisoners (Temporary Release) Act, 1962 to attend the Antim Ardas/Bhog Ceremony of his father, who passed away on 18.09.2024. 2.

Short reply by way of affidavit dated 29.09.2024 of Harjit Singh, PPS Superintendent of Police, Sub Division Banga, District Shaheed Bhagat Singh Nagar on behalf of respondent No.1 filed in Court today with a copy thereof to learned counsel for petitioner is taken on record subject to just exceptions.

Learned counsel for the State while referring to affidavit dated 29.09.2024 verifies that petitioner's father Sh. Nirmal Singh @ Nimma has indeed passed away on 18.09.2024 and that petitioner was allowed to attend the cremation on 19.09.2024 in police custody. CRWP-9361-2024 (O&M) -2and his elder brother is taking care of the family. It is verified that Antim Ardas/Bhog Ceremony of petitioner's father is to take place on 02.10.2024. While opposing release of the petitioner on parole for 2 weeks, it is submitted that there is no objection if the petitioner is allowed to attend Antim Ardas/Bhog ceremony of his father on 02.10.2024 in police custody. Learned counsel for the petitioner does not raise any objection to this course of action.

In view of the above, it is directed that the petitioner be taken and permitted to remain from 10:00 AM to 04:00 P.M in police custody for Antim Ardas/Bhog ceremony of his father Nirmal Singh @ Nimma to be held on 02.10.2024, at Village Jandiala, District SBS Nagar. 5.

Petition is disposed of accordingly.
