The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue his passport.

The petitioner was issued passport on 06.09.2013 which has expired on 05.09.2023. The petitioner applied for re-issuance of passport, however, respondent has issued show cause notice dated 09.08.2023 calling upon the petitioner to furnish explanation with respect to an FIR pending against him. The police after completing investigation has already filed report under Section 173 Cr.P.C..

Learned counsel for Union of India submits that police has already filed report under Section 173 Cr.P.C. though charges have not been PARAMJIT KAUR SAINI 2023.10.30 17:38 I attest to the accuracy and authenticity of this order/judgment

CWP No.22691 of 2023 -2- 2023:PHHC:138061 framed. The petitioner has not made full and true disclosure in the application.

Without commenting upon merit of the case, the respondent is directed to consider application of the petitioner and pass an appropriate order within four weeks from today. If no adverse material is found against the petitioner, the passport may be issued and it may directly be deposited with trial court where trial arising out of FIR No. 189 of 2019, under Sections 406 and 420 of IPC, registered at Police Station Kotwali Rohni, Ranchi is pending against the petitioner.

The petitioner is at liberty to move an appropriate application before trial court for vising abroad.
