(ORAL) Through this petition under Section 482 Cr.P.C., prayer has been made for issuance of directions to respondents No. 2 and 3 to register an FIR under Sections 406, 420, 409, 467, 468, 379 and 120-B IPC and other relevant offences under IPC against respondents No. 5 to 7 and proceed against them, in accordance with law. Heard.
On instructions from ASI Tarlochan, learned State counsel submits that out of total 7 cheques issued by the petitioner, 2 were misplaced in the bank against which DDR No. 39/93/19 dated 11.10.2019 was recorded, whereas remaining 5 original cheques are lying with the Bank.
Learned counsel for the petitioner contends that purpose of instant petition would be achieved, if, remaining 5 original cheques lying RISHU KATARIA 2020.01.27 18:34 I attest to the accuracy and integrity of this document
CRM-M-45950-2019 -2with the bank are returned to him.
In view of the above, the instant petition is disposed of with a direction to respondents No. 4 to 7, to return the remaining 5 original cheques issued by the petitioner to him, on clearance of entire loan amount, if any.
