Present petition has been filed for issuance of directions to reinstate the petitioner back in service on the post of Assistant Lineman with all consequential benefits including back wages and interest. 2.

Learned counsel appearing on behalf of the respondents stated that it is a case where the petitioner was kept out of service because of electrocution. He was not coming on duty and thereafter now he has been granted all the benefits pertaining to the grant of salary etc. and has been taken back in service. Therefore, the present petition has been rendered infructuous.

However, on the other hand, learned counsel for the petitioner stated that although the salary has been paid and the petitioner has been taken back in service but he is also entitled for grant of interest for which he is ready to file an appropriate application before the respondent No.2. CWP-22736 of 2023 (O&M) 2024:PHHC:049659 direction may be issued to respondent No.2 to consider the same in accordance with law.

Learned counsel for the respondents stated that in case the petitioner files such an application for grant of interest on the payment of salary etc., the same shall be considered in accordance with law within a period of three months.

In view of the aforementioned circumstances, the present petition is disposed of with a direction to respondent No.2 that in case, such an application is filed by the petitioner, respondent No.2 shall consider the same in accordance with law within a period of three months by passing a speaking order in this regard.
