**** ARUN PALLI, J (Oral) Contends that the petitioner had submitted his bid for transportation of food grains for Cluster Raikot 1 and 2. However, upon technical evaluation, the District Tender Committee, Ludhiana (respondent No.3), vide impugned order dated September 20, 2024 (P2), declared the petitioner non-responsive/non-compliant. Being aggrieved, the petitioner in terms of the Punjab Food Grains Transport Policy, 2024, has filed an appeal before the first Appellate Authority on September 23, 2024 and the same is pending consideration. It is urged that the matter being time sensitive, the authorities ought to have taken cognizance of the appeal preferred by the petitioner. Particularly, when it is accompanied by an application for interim relief. So much so, no date of hearing in the appeal has been fixed by the authorities, to date.

Served with the advance copy of the petition, Mr. Jastej Singh, learned Deputy Advocate General, Punjab, is present in Court on behalf of the respondents. At the outset, he, on instructions from the competent authority, submits that date for consideration of the appeal, as also the application for stay, shall be notified within a day. C.W.P. No. 24854 of 2024 That being so, learned counsel for the petitioner submits that nothing substantive survives in the petition and the same be disposed of in terms of the statement made by the learned State counsel. In the wake of the position sketched out above, and in terms of the statements made by learned counsel for the parties, this petition is accordingly disposed of.

This Court is sanguine that the authority shall consider/examine the matter in the right earnest, and pass appropriate orders within the time indicated by learned State counsel, assigning reasons in support thereof. Needless to assert that this order shall not constitute an expression of opinion on the merits of the case of either party, for, as indicated earlier, the competent authority shall examine the grievances of the petitioner, strictly in accordance with law.
