IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH RSA-5260-2017 (O&M) Date of decision : 10.01.2019 Kartar Kaur and others ... Appellants
Versus
Balbir Kaur and others ... Respondents
CORAM:
HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr. G.S. Sidhu, Advocate for the appellants.
**** AMIT RAWAL, J. (ORAL) The short point involved in the present regular second appeal is that the appellants-plaintiffs have already a decree dated 15.11.1999 in Civil Suit No.788 of 1992 and lost the right in respect of land measuring 11 kanals, as per the sale deed dated 12.06.1984 and 12.02.1985, whereas the present suit challenging the same very sale deed has been filed in the year 2009, despite the fact that they were party in the previous round of litigation. In such circumstances, the suit is not maintainable and rightly so, has been dismissed on the ground of delay.
No ground is made out for interference, much less, no substantial question of law arises for determination. The present second appeal is dismissed on merits as well as on the ground of delay of 44 days. 10.01.2019 Yogesh Sharma ( AMIT RAWAL ) JUDGE Whether speaking/reasoned Yes/ No Whether Reportable Yes/ No
