Seeking quashing of non-bailable warrants dated 24.03.2023 and 16.08.2023, the peƟƟoner has come up before this Court under SecƟon 482 CrPC. 2.

Counsel for the peƟƟoner has drawn aƩenƟon of this Court to Annexure P-5 which reads as follows:- "Feeling aggrieved by framing of charges in her absence, the accused has come up before this Court by filing the present revision peƟƟon under SecƟon 401 CrPC. The complainant is represented by his counsel and the State has also got instrucƟons in this regard. State counsel submits that iniƟally, the peƟƟoner was arraigned as an accused, however, later on, in inquiry, she was not found present at the spot and accordingly, supplementary challan dated 14.10.2021 was filed, declaring her innocent. However, a perusal of the impugned order dated 2.3.2023 reveals that there is no reference to the supplementary challan.

Given above, the impugned order is set aside. It is clarified that in case the concerned Court wants to proceed further by framing charges against the peƟƟoner, it shall refer to the supplementary challan, vide which the peƟƟoner was declared innocent.

On the next date itself, non-bailable warrants were issued vide order dated 24.03.2023. Counsel for the peƟƟoner submits that the peƟƟoner is appearing on each and every date.

Given above, the impugned order dated 24.03.2023 whereby nonbailable warrants were issued is quashed and set aside. All pending applicaƟons, if any, stand disposed.
