Learned counsel for the petitioner, inter alia, contends that recovery in the present case pertains to 25 grams of heroin, which was recovered from the main accused, namely Harish @ Harsh and Gurdeep Singh @ Kala. Petitioner, who is related to Harish @ Harsh as his uncle, has been implicated in the case solely on the basis of a disclosure statement made by the coaccused.

It is submitted that apart from the disclosure statement, there is no other independent or corroborative evidence available with the prosecution to substantiate the allegations against the petitioner on a prima facie basis. Moreover, petitioner is ready to join the investigation and fully cooperate, if protected from arrest by this Court. Thus, prays for grant of concession of anticipatory bail to the petitioner in the present case.

On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts in appearance on behalf of the respondent - State, and seeks some time to file status report in the matter. However, to prevent loss to the State Exchequer, the appearance of the concerned respondent(s) in the subsequent proceedings will only be recognized, if the requisite process fee is deposited by the petitioner(s), within a period of one week from today.

Meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of
