In the present petition, the prayer of the petitioner is that a candidate namely Kavita Devi lower in merit than the the petitioner has been appointed as a Forest Guard, whereas, the petitioner has not been given appointment, which is totally arbitrary in law. 2.

Learned counsel for the petitioner submits that as per revised merit list, which has now been released by the respondents, the name of the petitioner is at serial No. 165, whereas, candidate at Serial No. 167 namely Kavita Devi has already been appointed a Forest Guard, hence the respondents are under obligation to grant the benefit of appointment to petitioner as a Forest Guard.

Mr. Pankaj Middha, Addl. A. G. Haryana, who is present in Court, accepts notice on behalf of State of Haryana-respondents 5.

Learned State counsel submits that petitioner has filed the present petition without approaching the department concerned by raising the grievance as raised in the present petition, hence, in case, any grievance RIYA 2023.10.13 15:58 I attest to the accuracy and integrity of this document

CWP No. 22740-2023 -22023:PHHC:130405 of the petitioner qua the appointment of a candidate lower in merit than the petitioner is raised before the appropriate authorities, the said grievance will be considered and decided within a period of eight weeks from the date of receipt of a copy of this order by passing appropriate speaking order. 6.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed, at this stage, with liberty to file a representation with respondents so as to raise all the claims as raised in the present petition.
