NIDHI GUPTA J. (Oral) Prayer in this petition is for deleting the Charge under Section 376 IPC made against the petitioner in the FIR No.116 dated 18.4.2023, under Sections 376 and 511 IPC, registered at Police Station Dhauj, District Faridabad, Haryana.

Learned counsel for the petitioner submits that the complainant in the present case has turned hostile and submit that therefore Section 376 IPC in the matter is not attracted.

Learned State counsel, on instructions from the Investigating Officer, submits that out of total 10 prosecution witnesses, 04 have been examined.

In view of the fact that the trial has already commenced, no direction is required to be issued in the matter. Consequently, the present petition is dismissed.
