Aggrieved by dismissal of the bail by the Sessions Court despite the complainant not supported the case of the prosecuƟon, the peƟƟoner has again come up before this Court by filing third bail peƟƟon under SecƟon 439 Cr.P.C in the FIR capƟoned above.

Counsel for the peƟƟoner submits that he would like to withdraw the present peƟƟon with liberty to file a fresh peƟƟon before the trial Court with clarificaƟon that the trial Court should not resort to any observaƟons made on merits in the previous peƟƟon for the reason that now the complainant has turned hosƟle. 3.
The prayer is genuine, as such, the same is allowed. 4.
Given above, present peƟƟon stands disposed of having been withdrawn with liberty to the peƟƟoner that he may file a fresh bail applicaƟon before the trial Court and trial Court shall decide the said bail applicaƟon preferably within two weeks from the date of filing of the same without being influenced by the earlier rejecƟon by this Court or trial Court. Liberty reserved to the peƟƟoner to come to this Court again, if need arises. All pending miscellaneous applicaƟons, if any, stand disposed of.
